The rules of using online reservation system throught www.airclub.pl website


System administrator of online service through www.airclub.pl website is Air Club Travel Center Stanisław Modliński, an enterprise with registered place of business in Warsaw (00-095), at 28, Senatorska St. Reservation System available through www.airclub.pl offers its Users the following facilities:

  1. information on currently available flight connections,
  2. booking airline ticket for the chosen flight connection,
  3. purchase of airline ticket for the chosen flight connection.

This reservation, can not be treated as an commercial offer, unless it will be confirmed by telephon or e-mail by the Agent, that such ticket can be issued.

Online Reservation System available through http://www.airclub.pl may be used only upon acceptance of the terms specified below. Such acceptance is a statement of will and leads to legal obligation arising between the User and Air Club Travel Center.

  1. DEFINITIONS
    1. Reservation System - a program enabling the User to search for domestic and international flight connections, establish air fare due for the chosen connection and purchase airline ticket.
    2. The User - a person making use of the reservation system.
  2. GENERAL
    1. The Reservation System is made available by Air Club Travel Center, with registered place of business in Warsaw, at 28, Senatorska St.
    2. The present Rules determine regulations constituting the legal basis for making use of the Reservation System.
    3. Every User is obliged to comply with the present Rules.
  3. USER'S RESPONSIBILITY ARISING FROM THE USE OF RESERVATION SYSTEM THROUGH www.airclub.pl WEBSITE
    1. Acceptance of the Terms. The User shall accept the terms specified in the present Rules and assume full responsibility for all activities arising from making use of the Reservation System. The User shall confirm his/her full legal capacity to act and create legally binding obligations, and by accepting below specified terms he/she shall take full financial responsibility arising from making use of the Reservation System.
    2. Acting on Behalf of a Third Person. The User shall make use of the Reservation System on own behalf. Undertaking activities on behalf of a third person shall require a legally binding power of attorney. The User shall bear full responsibility for acting without the power of attorney or exceeding its limits.
    3. The Use of False Data. Using a false name or a name of a third person upon inquiry about a booking, or payment for the booked airline tickets with a third person's credit card, are not permitted without the valid power of attorney.
    4. The Scope of Using the Reservation System. The User shall make use of the Reservation System entirely to inquire about a booking and to purchase airline ticket.
    5. Limitation of Liability. Air Club does not guarantee faultless use of the Reservation System, without failures or breaks, and that establishing a connection thereto is possible at any time. Air Club does not guarantee either that in each case the result of query meets User's expectations as to its essential contents, accuracy or usefulness of the obtained information. Air Club warns that the User makes use of the Reservation System entirely at own expense and risk.
  4. RESERVATION AND PURCHASE OF AIRLINE TICKETS
    1. Required Travel Documents. Upon making a booking the User shall be responsible for holding the proper travel documents, like e.g. passport or visa, or obtaining them on time. Air Club is not obliged to offer any information concerning the required documents. The Users may reach information concerning visa or passport requirements of a particular country online at http://www.airclub.pl/niezbednik-turysty/wizy (polish version only), or obtain it directly at the diplomatic post.
    2. Selling and Issuing Airline tickets. Airline tickets shall be sold and issued by Air Club Travel Center, with registered place of business in Warsaw, at 28, Senatorska St., hereinafter referred to as Air Club. Air Club is the IATA (International Air Transport Association) accredited travel agency and is in the right to make bookings, sell and issue airline tickets through the Amadeus Global Distribution System. Reservations and transactions carried out online through airclub.pl website make use of Amadeus Global Distribution System.
    3. Inquiry about a Booking. The User shall inquire on the possibility to make a booking by: choosing one of the booking options proposed by the Reservation System, shown as the list of connections available on the chosen routing (in accordance with the conditions defined by the User in the reservation form available at www.airclub.pl) and correctly entering into the reservation form (that is an integral part of the Reservation System) full data required to make a booking in Amadeus GDS, and full data required to complete the transaction of purchasing airline ticket, followed by reading through and acceptance of the present Rules and conditions of purchase and return of airline ticket. Air Club reserves the right to establish the earlier date for purchasing airline ticket than the one specified by an airline.
    4. Booking and Price Confirmation. The confirmation of the booking shall be forwarded to the User via e-mail, to the address entered by the User, specifying the booking reference, information on the chosen air connection, the total price of airline ticket at the moment of forwarding the confirmation and the form of payment. The price of airline ticket is quoted in Polish zloty (PLN), separately for each chosen flight connection. As air fare as well as taxes and airport fees may be determined by carriers both in PLN and in other currencies, upon issuing airline ticket its price may slightly differ from the previously quoted one due to daily fluctuations in currency exchange rates. Air Club, acting as the representative of airlines, reserves the right to change the price of airline ticket before its issuance, due to the change in exchange rate of the applicable currency or increase the level of tariffs by the carrier..
    5. Collection of Airline tickets. After payment, the tickets shall be forwarded by e-mail. The booked ticket may also be collected by the User in Air Club office.
  5. THE PRICE OF AIRLINE TICKET
    1. The price of airline ticket is quoted by the Reservation System in Polish zloty (PLN).
    2. The price of airline ticket includes a tariff (an air fare), taxes and airport fees and a transaction fee.
    3. The transaction fee is the fee due for the issuance of airline tickets. Airline tickets booked online through airclub.pl website are subject to the following transaction fees, regardless of the carrier operating the chosen connection:
      1. international flights - 65 PLN,
      2. domestic flights - 40 PLN, gross,
      3. refunds - 50 PLN.
    4. The reason for significant difference in price from the expected level may be the lack of seats in the cheapest booking classes. It is recommended to check departure and return options on the closest dates, or contact Air Club office, phone: (22) 829 95 00 or e-mail: info@airclub.pl.
    5. The price quoted during the booking process shall not be considered a binding trade offer until it is confirmed by Air Club. The confirmation may be forwarded by e-mail or telephone, according to the contact data entered by the User in the reservation form.
  6. PURCHASE OF AIRLINE TICKET
    1. Purchase of Airline ticket on the Day of Making the Booking. Before purchasing airline ticket the User is obliged to be acquainted with the present Rules and accept the contents, as well as to be acquainted with the conditions of air fare (terms of purchase and return of airline ticket) concerning the chosen flight connection. (The conditions are available on the website during booking or purchase transactions, or directly from the ticketing agent, phone: (22) 829 95 00. The conditions of purchase and return are imposed by airlines). Personal data of the person, for whom the booking is made, should be the same as the data in his/her identity document entitling for border crossing; otherwise the person shall not be admitted on board the aircraft. In such case the amount paid for airline ticket is nonrefundable. The purchase of airline ticket booked via the Reservation System is possible only through Air Club.
      Attention! Airlines allow to issue airline ticket within 72 hours from making the booking, or within 24 hours in case of some tickets booked and issued at special fares. Not complying with this condition results in cancellation of User's booking. Air Club office is open from Monday till Friday at 8.00 am - 6.00 pm. and on Saturdays at 10.00 am - 3.00 pm., and tickets may be issued only during the office hours. Air Club shall not be held responsible for the booking cancelled under the following circumstances:
      • The booking made at such a time that makes it impossible for Air Club to issue the ticket during a/m office hours.
      • Failure to pay (receive the full amount due for airline ticket on Air Club bank account).
    2. Purchase of Airline ticket on the Day Other than the Day of Booking. If airline ticket is purchased on the day other than the day of booking, before arranging the payment (bank transfer, cash, credit card) the User should contact Air Club by phone: (22) 829 95 00, or by e-mail: info@airclub.pl, to determine the price of airline ticket in PLN in accordance with currency exchange rates on the day of purchase.
  7. FORMS OF PAYMENT
    1. Credit Card Payment through airclub.pl Website. Payment with credit card shall be done only by the owner. In accordance with the Polish and international law regulations, the use of third person's credit card to purchase airline ticket constitutes an offence against property and is punishable under Article 278 (1) of the Penal Code. Any attempt to commit the above offence shall be reported by Air Club to appropriate law enforcement bodies. Authorization and settlement of credit card payment is arranged directly by airlines through Amadeus GDS, and in the "order by phone" system by Card-Point. In case when:
      • an approval is not granted,
      • payment with a particular credit card type is explicitly not permitted by carrier,
      • payment with a credit card for a particular type of air fare is explicitly not permitted by carrier,
      Air Club shall contact the User by telephone, in order to establish other form of payment. If telephone contact is not possible, then e-mail shall be forwarded. Both telephone and e-mail contacts shall be based on data entered by the User in the reservation form. The proper authorization of credit card payment requires the User to enter the following data:
      1. credit card type,
      2. credit card number,
      3. credit card expiry date,
      4. cvv/cvc code (to be found on the reverse side of the credit card; it is represented by the last three digits printed along with the card number on the signature strip).
      Authorization of credit card payment requires the transfer of data to the Reservation System and to Card-Point. Then the credit card account of the number quoted by the User shall be charged with the payment amount determined in accordance with the procedure specified under 5 of the present Rules. The positive result of authorization process means the ticket has been purchased. If it is not possible to block the due amount on the credit card account, airline ticket is not purchased. Air Club shall not be held responsible for the process of credit card authorization carried out by the airline, and warns that the company has no influence on the timing of charging the User's credit card account.
      An electronic ticket, paid for with a credit card, shall be forwarded by e-mail after settlement, to the e-mail address entered by the User.
    2. Payment with Bank Transfer. Payment with bank transfer is permitted only when the booking is made at least 5 working days in advance of the date required for purchasing airline ticket. Bank transfers should be forwarded to the following bank account: BANK MILLENNIUM S.A., account number 73 1160 2202 0000 0000 8961 7014; beneficiary: Air Club Travel Center Stanisław Modliński, 00-095 Warszawa, ul. Senatorska 28.
      The transfer should be done at the bank, during the first ELIXIR session, at the first possible date after booking and confirmation thereof. The confirmation of bank transfer should be forwarded by fax: (22) 829 95 50, and include the following data: booking reference, first name and family name of passenger. In case of airline tickets with the discount applied to holders of Euro<26, ISIC or ITIC cards, it is required to include also: copy of the applicable card, its number and validity date, date of birth. The electronic ticket shall be forwarded by e-mail or collected by the User in Air Club office, after the full amount has been received on Air Club bank account.
    3. Payment with Cash or Credit Card in the Office. Airline ticket shall be collected after payment has been done in Air Club office, as only then its purchase and collection is possible. Payment may be done in cash or with a credit card (the accepted types include Visa Classic, MasterCard, Diners Club or American Express); then the CCCF (Credit Card Charge Form) document, confirming the charge on a credit card account, has to be signed by the credit card owner. Payment with electronic credit cards (Visa Electron, Maestro) shall not be accepted.
      When the credit card payment is declared after airline ticket has been issued, then the additional fee amounting to 2.5% of the gross amount is collected, due for authorization of credit card payment.
  8. TICKET COLLECTION AND DELIVERY OPTIONS. COLLECTION AND DELIVERY OF AIRLINE TICKET - GENERAL RULES
    1. Delivery or collection of airline ticket depends on the purchase of airline ticket after booking thereof by the User. The purchased airline ticket may be delivered to the e-mail address entered by the User in the reservation form or personally collected by the User in Air Club office. 
  9. RETURN OF AIRLINE TICKET
    1. The Customer has the right to return airline ticket purchased online through www.airclub.pl website upon meeting the following conditions: airline ticket is returned before the date set as departure date and the applicable air fare allows for refund. The return of airline ticket requires the deduction of a cancellation fee depending on the applicable air fare; in case of low fare tickets the fee may amount to 50% or even 100% of ticket value! It is particularly applicable to promotional air fares. Some promotional air fares do not allow for any changes in airline ticket or its return to the issuing office before starting the travel. Then the renouncement of travel leads to the loss of the total amount paid for airline ticket. It is especially recommended to read carefully the conditions of air fare before purchasing airline ticket. Transaction fee is not subject to refund in any case.
    2. Airline tickets that are subject to refund, should be forwarded by e-mail  to Air Club e-mail address: info@airclub.pl. The amount due to the User for the returned airline ticket shall be returned to Customer, within 30 days after airline ticket has been received by Air Club.
  10. CANCELLATION OF BOOKING BECAUSE OF THE REASONS DUE TO CARRIER Air Club shall not be held responsible for changes in booking status or booking cancellation, done by airlines in the bookings made through www.airclub.pl website.
  11. INFORMATION FOR CUSTOMERS Air Club shall inform the User on changes in his/her booking done by airlines, to the e-mail address entered by the User in the reservation form.
  12. CHANGE OF BOOKING AFTER PURCHASING AIRLINE TICKET. THE RIGHT TO MAKE CHANGES The User has the right to change booking (departure date or hour, etc.) after airline ticket has been purchased, according to the conditions of the air fare (see: terms of purchasing airline ticket). The conditions for making changes in booking are determined by airlines.
  13. CLAIMS Claims concerning booking and purchase of airline tickets should be reported in writing to Air Club Travel Center in Warsaw, at 28, Senatorska St., or by e-mail: info@ airclub.pl, as soon as possible, but not later than within 7 days after receiving the ticket. Any claims resulting from flight cancellation, change or delay by the airline shall be filed to the airline. Carriers bear responsibility conditions of the Warsaw Convention and the Montreal Convention.
  14. PROTECTION OF PERSONAL DATA Personal data are administered by Air Club Travel Center, 28, Senatorska St., 00-095 Warsaw. By accepting the present Rules I agree to the transfer of my personal data by the Administrator of Personal Data i.e. Air Club in Warsaw, to Anixe, PLC in Wrocław, in order to fulfill obligations arising from concluded agreement on purchase of airline ticket. The personal data shall be protected in accordance with the Act on Personal Data Protection. Personal data shall be made available on voluntary basis. The User has the right to accessing his/her personal data, introducing corrections thereto or demand cancellation thereof.
    Air Club shall undertake all possible efforts to provide Users of the Reservation System with access to the latest types of products, services, promotions and pricelists available on www.airclub.pl website. Air Club reserves the right to inform Users on any promotional activity available on www.airclub.pl.
  15. MISCELLANOUS
    1. Application of the Civil Code. The issues not covered by the regulations of the present Rules shall be governed by the regulations of the Civil Code. All disputes arising from services rendered by Air Club shall be settled by the courts of Air Club's registered place of business.
    2. Exclusion from Responsibility. Air Club shall not be held responsible for damages to the User arising from the fact of failure to travel, caused by force majeure as defined in the regulations of the Civil Code, as well as the reasons beyond Air Club control, in particular a strike of airline employees, airport employees and others. Air Club issues airline tickets on behalf of and for airlines. The responsibility of airlines for organization and results of air transportation are governed by international conventions (The Hague Convention of 1929, The Warsaw Convention of 1955 and IATA resolutions). Air Club has neither the right nor the possibility to interfere with their contents.
    3. Air Club reserves the right to unilaterally introduce changes into the Rules. Every User is obliged to get acquainted with the contents of the Rules before making the booking, and each time he/she is bound with the regulations of the Rules applicable at the moment of booking and purchasing airline tickets.
  16. USER'S ACCEPTANCE I declare all regulations of the present Rules to be clear and understandable. I hereby accept all regulations of the present Rules without any reservations.
